Glitch T-Shirts and Merch

I reeeaaallllyyyy want some Glitch merch. Like, real bad. So in the absence of seeing any elsewhere (as long as I'm not violating or infringing on anything) I'm going to start making some so everybody else can have some too. I've set up a storefront for some things I drafted, and you can order them right this second:

If anyone has any suggestions for the next ones, let me know. Or if nobody likes these to begin with, also let me know. Or if I shouldn't even be making these. Or anything else. All I know is I'm about to place the first order now!

  • One's dedicated to each of the giants, with an emblem on the front. I'd wear an emblem of spriggan.... I know a guy that could cast in pewter the emblems as key rings....... If there was enough interest... :)

  • Wow, the IRL emblem idea is awesome. I wouldn't even need them on a keychain, just as a coin to carry around.

    Am I allowed to use the pictures of the emblems on a shirt? How does the staff feel about all of this?

  • The artwork is certainly covered by copyright. You would have to check with the staff here on whether using just the names is OK (as in the shirt you posted). It would depend on whether the names were copyright also (they probably are).

    It would not be to spoil your fun that TS would stop you from producing materials with the art. It is that to protect the art from commercial producers (mass production and sale at Toys R Us) they have to show that TS has consistently enforced their copyright. Otherwise it could fall into public domain.

    TS can allow non-commercial use of the art without this concern, but once an exchange for value takes place, their legal standing becomes much more precarious. That means you can probably get away with making a shirt for yourself, but once you sell or distribute them, TS really has no choice other than asking you to stop and then taking legal action if you don't.

    It does not mean that they don't trust or love you - they simply have to protect their own property to maintain legal control of it.

  • Exactly! That's why I'm hoping for a staff response before I get too far into it. I will absolutely do whatever I need to so nobody gets put in a bad place. It's so much fun though!

  • I'm not sure they'd go for that. I highly doubt I can do any better than their design team, but I suppose this takes the work out of it on their part. I just want to represent Glitch outside my computer, as I'm sure most of us do!

  • I would totally wear each of the Giant's shirts. If TS slapped them up on CafePress or the like we all could be sporting them in time for the real launch pimping and TS would get the proceeds and be in control without having to sweat any kind of production.

  • They have a design person now. They are planning on producing stuff.
     "Blame it on the Alakol" is not a trademarked phrase though and can likely be considered parody. Parody is legally protected to use and publication, even for a fee. I think they'll likely leave it alone.

  • Zazzle or Cafe? - TS could use either to make things available easily.

    I prefer zazzle.  There quality is good and they ship so fast it will make your head spin.  Prices are resonable too.  I use them to make products with my logo all the time. 

    Need some CyberCraft Robots shoes while you're waiting for your Glitch swag?  'Cause I got some!

    Was reading that, so...I think at least emblem shirts idea will be a no (which sucks because that would've been awesome). I'd been wondering some of this on my own, finally looked this up. So, looks like LEGALLY, will be no on anything avatar, item, art related may have issues. I really looked this up like....three minutes ago, so does anybody else who knows this stuff better want to give an interpretation for the rest of us curious glitches?

  • I'd say...ask before putting anything together or wait until TS puts out their own merch. It's a lot better than getting a cease and desist letter or worse.

  • If you ask nicely they might give yo the rights to use their copyrights and trademarks in creating your products, and in return you pay them a licensing fee for each sale. You should contact them and ask.

    If Glitch is going to get as big as we all think it will, merchandise will be a huge thing. You should get in on the ground floor. Especially Real-life replicas of in-game items (Shrines, coins, house models, trees that talk when you pet them, etc…) would definitely be worth making once the game grows to five or six times its current size, which would be easy for Glitch.

  • The t-shirt with the phrase "Blame it on the Alakol" is not within the ToS. That is player created content and not content created by the company. It's also parody. As long as no logos or anything else directly tying the design to Tiny Speck or Glitch is incorporated int the desight, he has full legal right to produce and sell. But he cannot copyright the statement as it is "prior art"

  • Or a pink one with a pig tail on the back, and a snout/face, that says "Bite me." Or maybe Glitch-themed shirts parodying band shirts? Or sports team things for the different regions? "Ajaya Miners" seems like like an easy one.
